The Oakland Unified School District (OUSD) is adopting a districtwide “bell-to-bell” cell phone policy in compliance with California's Phone-Free Schools Act (Assembly Bill 3216), which requires all public-school districts, county offices of education, and charter schools to establish policies limiting or prohibiting student smartphone use during the school day.
Unlike a statewide phone ban, AB 3216 allows each district to develop its own policy. Supporters of the law say limiting phone use helps reduce classroom distractions, cyberbullying, and social media conflicts while improving student engagement and academic performance.
Under OUSD’s policy, students in Transitional Kindergarten through Grade 12 must keep cell phones, smartwatches, and other personal communication devices turned off or silenced, out of sight, and stored in a backpack, phone pouch, or other secure location from the first bell until dismissal.
The policy includes exceptions for emergencies, teacher-authorized educational use, documented medical needs, and students whose Individualized Education Program (IEP) or Section 504 Plan requires access to a device. Families with documented safety concerns may also work with school administrators to develop appropriate communication plans.
District officials say a consistent bell-to-bell policy will provide clear expectations across all OUSD schools while increasing instructional time, reducing classroom disruptions, and improving school climate. The district will provide staff training, family communication materials, and implementation guidance to support the transition.
The policy also includes student privacy protections. School staff may not search a student's phone without parental consent except in limited circumstances as permitted by law, and the district will not monitor or collect information from students’ personal devices.
